मुजफ्फरपुर – जिले के काजीमोहम्मदपुर थाना क्षेत्र के पावर हाउस चौक पर सिपाही द्वारा डंडे से मारकर अधिवक्ता की आँख फोड़े जाने के मामले में राष्ट्रीय मानवाधिकार आयोग ने बिहार सरकार के मुख्य सचिव को पीड़ित अधिवक्ता को 25 हजार रूपये मुआवजा देने का आदेश दिया है।
विदित हो कि आयोग ने मामले में मुख्य सचिव के विरुद्ध ‘कारण बताओ’ नोटिस भी जारी किया था और मामले में दो सप्ताह के भीतर जबाव माँगा था, लेकिन मुख्य सचिव द्वारा कोई जबाव नहीं दिया गया। तत्पश्चात आयोग ने विगत 21 अगस्त को मामले की सुनवाई के दौरान सख्त रुख अपनाते हुए कहा कि सरकार अपनी मुआवजा देने की जबावदेही से नहीं भाग सकती है, क्योंकि यहाँ एक लोक सेवक ने मानवाधिकार का उल्लंघन किया है, जिस कारण पीड़ित को अपनी एक आँख गँवानी पड़ी। आयोग ने मुख्य सचिव को पीड़ित को 25 हजार रूपये मुआवजे के रूप में देने का आदेश दिया है तथा आदेश के अनुपालन हेतु चार सप्ताह का समय दिया है।
विदित हो कि 7 फरवरी को अधिवक्ता पंकज कुमार रात्रि के लगभग 11:40 बजे पटना से अपने आवास मुजफ्फरपुर लौट रहे थे, तब पावर हाउस चौक पर पहले से मौजूद काजीमोहम्मदपुर थाने के पुलिसकर्मी वाहन जाँच के लिए खड़े थे। पुलिसकर्मियों द्वारा उनकी गाड़ी को रोका गया और पूछा गया कि वे कहाँ से आ रहे हैं? जबतक अधिवक्ता कुछ बोल पाते तबतक पुलिस पदाधिकारी द्वारा उन्हें गाली देते हुए पुलिसकर्मियों को उन्हें मारने का आदेश दे दिया गया। उसके बाद एक पुलिसकर्मी के द्वारा अधिवक्ता पंकज कुमार के आँख को डंडे से भोंक दिया गया। वे दर्द से कराहते हुए ज़मीन पर गिर गए। तब सभी पुलिसकर्मी वहाँ से भाग गए। अधिवक्ता पंकज कुमार का ईलाज शंकर नेत्रालय कोलकाता में हुआ। उनकी एक आँख की रौशनी खत्म हो चुकी है।
पुरे मामले की जानकारी पीड़ित अधिवक्ता पंकज कुमार ने मानवाधिकार मामलों के अधिवक्ता एस. के. झा के माध्यम से राष्ट्रीय मानवाधिकार आयोग, नई दिल्ली तथा बिहार मानवाधिकार आयोग, पटना को दी थी। जिसपर सुनवाई करते हुए राष्ट्रीय मानवाधिकार आयोग ने मुआवजे हेतु कार्रवाई की है। मानवाधिकार अधिवक्ता एस. के. झा ने बताया कि यह पूरा प्रकरण मानवाधिकार उल्लंघन के अतिगंभीर श्रेणी का मामला है। आयोग मामले को लेकर शुरू से ही काफी सख्त है और आयोग के द्वारा मामले को काफी गंभीरता से लिया गया है।
विदित हो कि मामले में अगली सुनवाई 8 नवंबर को होगी, जिसमें पीड़ित अधिवक्ता को 20 लाख रूपये मुआवजा दिलाने हेतु एवं दोषी पुलिसकर्मियों को बर्खास्त कराने हेतु अनुरोध किया जायेगा। उन्होंने बताया कि अधिवक्ता पर हमला कतई बर्दाश्त नहीं किया जायेगा। इसके लिए दोषी पुलिसकर्मी को कानून का एहसास कराना जरुरी है।
